Terms & Conditions

Background

This agreement applies as between you, the User of this Web Site or Purchaser and Bliss Life, the owner(s) of this Web Site. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these Terms and Conditions, you should stop purchasing from the Web Site immediately.

No part of this Web Site is intended to constitute a contractual offer capable of acceptance. The Purchaser’s order constitutes a contractual offer and our acceptance of that offer is deemed to occur upon our sending a dispatch email to the Purchaser indicating that the order has been fulfilled and has been dispatched.

entire agreement

Seller is Bliss Life Ltd (registered in England & Wales, Registration number 07218641; at 107-109 Gloucester Road, South Kensington. London SW7 4SS.

Customer is the person or company to whom this document is addressed.

International Customer is person or persons outside the UK.

General

These terms and conditions are applicable to the supply of products supplied by the Seller, hereafter referred as Bliss Life, to the buyer hereafter referred as the Customer.

acceptance of orders

The Customer shall inspect the goods within a reasonable time after their receipt and shall be deemed to have accepted the goods unless within 14 days after their receipt the Customer shall have notified the seller that the goods are rejected. (This does not however affect the customer’s statutory rights).

prices

All prices are quoted in Pounds Sterling (GBP) and are inclusive of VAT (IF APPLICABLE) (as may be prescribed by law from time to time), unless otherwise specified.

delivery

Any date or period for delivery shall be considered as indicative only, although it is our policy to try to despatch all orders within 3 working days. Any products not available at the time of your order will be sent to you, as soon as possible, when received from the supplier. Bliss Life cannot be held responsible for delays in the delivery caused by the supplier, or any other third party.

transportation and risk of loss

In the event of an order being lost by a third party, Bliss Life bears no risk once it has left their trading premises. Where goods have been received damaged, a refund/ exchange application will only be acknowledged if the goods are returned together with their original packaging within 14 days of order to Bliss Life.

Where the goods are signed for, the customer bears the risk once the goods are signed for. If a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods.

In the event of either of the above, Bliss Life will forward a claim to DPD (UK) on the behalf of the customer. Before this can be processed, Bliss Life will issue the customer with a 'Lost Orders Form' which must be completed and returned before any claim can be pursued. Any refund/ exchange given is at the discretion of the management of Bliss Life. Failure to give accurate information while making a claim may lead to a prosecution from DPD (UK).

cancellation or modification

Any order placed with and accepted by Bliss Life may be canceled by Buyer only upon Seller’s approval in a writing signed by an officer of Seller and upon terms that indemnify Seller against any loss. Bliss Life will not accept order cancellations once a product has been delivered to a carrier, without charging a cancellation fee of twenty-five percent (25%) of order value to recover retrieval costs incurred. Bliss Life will not accept cancellations of special orders of non-standard, non-price list products. Seller may cancel all or any part of this order and discontinue its performance hereunder without liability to Buyer in the event Buyer materially breaches this contract, becomes insolvent, is the subject to bankruptcy protection, or is the subject of a receivership, liquidation, dissolution or similar proceeding.

taxes

Buyer is responsible for any tax or governmental charge imposed upon the sale or transfer of any product. Any such tax or governmental charge will be added to the total invoice amount. All prices are FOB Seller’s facilities. Applicable freight costs will be added to the invoice.

warranty and disclaimer

Seller warrants that the purchased Product is free from defects in materials and workmanship at the time of delivery. If an analysis is stated on the face of the Invoice, it is not intended to be a complete analysis and is not to be regarded as a specification or warranty, unless specifically stated in writing to be such.

limitation of liability

Buyer acknowledges and agrees that seller’s liability for any claims with respect to the products shall not exceed the amount paid by buyer for the products under the invoice. Such limitations on seller’s liability hereunder shall apply even if seller’s liability is due in whole or in part to its own negligence. Any action by or on behalf of Buyer or its successors or assigns for breach of this document must be commenced within one (1) year after the cause of action as accrued.

return of material

10.1 If the goods are to be rejected in the time limit set in clause 9 above, the Customer shall comply with the return procedure as defined in clause 10.2, below. Bliss Life will not accept any returned goods should the return not follow the aforementioned return procedure.

10.2 The Customer must follow the returns policy set out on within the FAQ section of BlissLife.co.uk.. This requires emailing delivery@blisslife.co.uk to notify their intention and reason for returning the goods.

10.3 In cases where the rejection of the goods is due to a defect or discrepancy in the order, the Customer is entitled to a full refund or replacement. The faulty or damaged product must be returned to Bliss Life before the refund or replacement can be issued.

10.4 In cases where the rejection is due to an incorrect order from the Customer or to dissatisfaction, the Customer is entitled to a partial refund (full refund less postage, where standard post & packaging has been incurred by Bliss Life). Goods must be returned to Bliss Life before the partial refund can be issued.

indemnity

Buyer shall defend, indemnify and hold harmless Seller and its affiliated or related companies from and against any and all claims, losses, liability, damages and expenses including, but not limited to, attorneys’ fees and cost of defense arising from, related to or in any way connected with or alleged to arise from or out of any asserted deficiencies or defects in Product caused by any alteration or modification thereof by Buyer with or without Seller’s consent, or improper handling or storage by Buyer, the breach of any term or condition stated herein, Buyer’s failure to label Product or Buyer’s improper labeling of Product regardless of whether the labeling was done with or without the advice of Seller, or any act or omission of Buyer including any Claims for or resulting from any injury to person (including death) or damage to property or for economic loss, several or comparative negligence, breach of agreement, breach of warranty or other breach of duty of or by Indemnitee or as a result of Indemnitee’s strict or other product liability. The foregoing indemnification shall not be construed to eliminate or in any way reduce any other indemnification or right which Indemnitee has by law.

payment

Payment are to be made in Pounds Sterling only, unless otherwise specified, and by one of the following payment methods:-


Paypal or using major credit cards as listed: Visa, MasterCard, Delta, Maestro, Switch, Visa Electron, and Visa Delta.

governing law and arbitration

These terms and conditions are governed and shall be interpreted in accordance with English Law. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.
